ELEVATOR SAFETY:


When you approach the elevator:

  • Know your destination.
  • Push elevator CALL button for the direction you want to go.
  • Stand aside for exiting passengers.
  • Wait for the next car, if the elevator is full.
  • Take the stairs if there is a fire.
  • Don't try to stop a closing door.
  • Wait for the next elevator.

When you enter and leave the elevator:

  • Enter and exit carefully.
  • Step up or down if the elevator floor and hall floor are not level.
  • Hold children and pets firmly.
  • Stand clear of the doors - keep clothes and carry-ons away from the opening.
  • Push and hold the DOOR OPEN button if doors need to be held open, or ask someone to push the button for you.

When riding on the elevator:

  • Stand next to the elevator wall.
  • Hold the handrail, if available.
  • Pay attention to the floor indications.
  • If the doors do not open when the elevator stops, push the DOOR OPEN button.
  • Stand clear of the elevator doors and stand aside for others that may be exiting.
  • If the elevator is full, wait for the next one.
  • Don’t attempt to step into or stop closing doors.
  • Push and hold the “door open” button if the doors need to be kept open.
  • In case of a fire, always exit using the stairs.
  • Once on the elevator, press the button for your floor and move to the back of the elevator so others may also board.
  • If the doors do not open when the elevator stops, push the “door open” button.
  • Once you reach your floor, immediately exit the elevator, but do not push anyone in front of you.
  • Watch your step when boarding and exiting. The elevator may not be level with the floor.
  • Never climb out of a stalled elevator and do not attempt to pry open the doors of a stopped elevator.
  • In an emergency, use the “alarm” or “help” button, the telephone or intercom to call for assistance.
  • Wait for help to arrive, but don’t try to leave an abnormally stopped elevator.

The Building Owner / Admin / Hi-Tech Lift Client Obligation:

a. Shall ensure, that the passenger / cargo elevator(s) shall be operated by a skilled elevator operator and all passengers shall travel only in the presence of the elevator operator. 2 elevator keys must always be readily available near the elevator door. These keys must be bought and kept by the client from anywhere in the market. CCTV cameras must be installed to monitor lift doors / machine room / lift cabin
b. Shall be solely responsible to arrange/purchase any defected part for replacement to the Company, upon intimation by the Company following an initial inspection of the elevator(s). The Company shall undertake replacement work within two (2) business days after receiving confirmation via email and phone call by the Customer that the part has been arranged/purchased from a third party. In the event the Customer decides to purchase the replacement part from the Company, delivery and installation of the replacement shall solely depend on the inventory available with the Company, time frames shall be provided on a case to case basis. The Customer shall be charged separately for any replacement part purchased from the Company.
c. Shall solely be responsible for maintaining appropriate environmental conditions including but not limited to temperature, humidity, prevention from rain, water etc. Customer must check site on daily basis before starting the elevator for example if high voltage is coming then elevator must not be switched on. The Customer shall inform about the environmental problems, if any. In the event, that the elevator(s) on the site requires rectification/cure of the environmental conditions, the Company shall rectify/cure any such defect on an additional charge paid by the Customer to the Company.
d. Agrees and acknowledges that all elevators (passengers / cargo) should have emergency brakes, cabin yokes and/or speed governors of any kind.
e. Ensure that the Cargo lift shall only be used for transporting cargo and not for passenger travel. No Child must travel in any type of lift alone no matter what circumstances are. Lifts must not be used in case of emergency / fire / earthquake / short circuit / water / rain coming on lift parts from any part of the building
f. Access to machine must be made as its safety standard.
g. Passenger / Cargo elevator shall be inspected by an independent third party certification body, as designated by the Company or SGS Pakistan (Private) limited before getting in contract with the maintenance company and at-least once every year as a standard safety precaution without any reminder from Hi-Tech Lifts Private Limited

2. Termination

a. Termination for Cause: Either party may terminate this Agreement for breach by the other party of a material term. The terminating party will provide written notice of the breach to the other party and provide a cure period of at least thirty (30) days to the breaching party. If the breach is not cured during such cure period, the non-breaching party may terminate this Agreement upon written notice to the other party.
b. Termination by Company: The Company may terminate this Agreement if the Customer fails to make payments specified in this Agreement and such failure continues for more than ten (10) days following written notice from the Company to the Customer.
c. Payment Upon Termination of the Agreement: Upon termination of the Agreement, the due dates for all outstanding Payments of the Customer for maintenance and repair Services will become due and payable immediately from the effective date of termination.
d. Effect of Termination on Obligations: Notwithstanding any other obligation provision in this Agreement, the Company will not by reason of termination be liable for compensation, reimbursement or damages for loss of prospective expenses incurred by the Customer.

3. LIMITATION OF LIABILITY:

a. Limited Warranty: All express or implied warranties, including but not limited to the implied warranties of merchantability, quality, and fitness for a particular purpose, which are hereby excluded to the maximum extent permitted by law.
b. Aggregate Liability: Except for claims for bodily injury or death of persons or damage to real and/or tangible personal property proximately caused by the negligence or willful misconduct of a Party, either Party’s liability to the other for direct damages for claims arising from or related to this Agreement shall be limited to the total amount paid by Customer to the Company for maintenance and repair services that gave rise to the claim for the period of twelve (12) months prior to the date of the cause of action.

4. GENERAL PROVISIONS:

a. Force Majeure: If either party is prevented from performing its obligations under this Agreement by causes beyond its control, including but not limited to civil commotion, war, governmental controls, casualty or acts of God, such defaulting party shall be excused from performance for the period of the delay and a reasonable time period thereafter.

b. Choice of Law and Forum: This Agreement shall be governed by the laws of the Islamic Republic of Pakistan. An action at law hereunder may only be brought before a court of competent jurisdiction in Karachi.

c. Survival of Terms: The provisions of this Agreement which by their nature extend beyond termination of this Agreement will survive and remain in effect until all obligations are satisfied.

d. Waiver: No waiver of any right or remedy in one instance by either party shall constitute a waiver of such right or remedy on any other occasion.

e. Entire Agreement: This Agreement, together with all documents referenced herein, constitutes the entire agreement between the parties and supersedes all prior oral and written agreements between the parties relating to the subject matter of this Agreement.

f. Assignment: This Agreement may not be assigned by either Party (in whole or in part) without the non-assigning Party’s prior written consent. Any attempted assignment without such consent shall be null and void.

g. Notice: All notices required under this Agreement shall be deemed effective when sent in writing by either registered mail, certified mail with return receipt requested or overnight mail sent to the address above and to the attention of the signatory to this Agreement.

h. Severability : If any provision of this Agreement is held to be invalid or unenforceable for any reason, the remainder of the provisions will continue in full force and effect. The parties agree to substitute a provision which approximates the intent and economic effect of the invalid provision.

i. Compliance with Laws: Each Party represents and warrants that all consents of government officials necessary for this Agreement to become effective will have been obtained before execution of this Agreement. At its own expense, each Party shall comply with all statutes, rules, ordinances and regulations which apply to or result from its obligations under this Agreement.

j. Independent Contractor: Each party acknowledges that the parties to this Agreement are independent contractors and that neither party shall represent itself as an agent or legal representative of the other party.

k. Headings and Precedence: The headings provided in this Agreement are for convenience only and will not be used in interpreting or construing this Agreement. In the event of any conflict between the terms of this Agreement and any Appendix, the terms of the Appendix shall prevail.

l. No Other Terms: This Agreement, its Appendixes referenced hereunder comprise the entire agreement between the parties. All prior oral or written Agreements or representations other than those included in this Agreement are hereby excluded from this Agreement.
